The article describes the impact of the recently released regulations under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") on estate planning. Readers are encouraged to review their estate planning documents and other legal documents to assure that protected health care information will be provided when necessary. In particular, each person should consider signing a separate authorization giving someone the ability to obtain and redisclose protected health care information.

California Legislature Makes Confidentiality Provisions Difficult in Elder Abuse Cases

Beginning January 1, 2004, defendants will have to make an affirmative showing that a Confidentiality provision is necessary before such a provision can be included in a settlement agreement. Also, it will be a sanctionable offense if it is shown that evidence was destroyed or altered.

On November 18, 2003 The Massachusetts Supreme Judicial Court held in Goodrich v. Department of Public Health that same-sex couples cannot be excluded from the benefits and obligations that marriage provides for heterosexual couples. The ruling extends many of the same rights that married couples in the Commonwealth enjoy to same-sex couples. However, the ruling does have its limits.
