Last week, the SCBA successfully halted a zoning request for a sexually-oriented business on John W. Carpenter Freeway, a 23,000 square foot empty building near Regal Row and 183. The zoning is light industrial.
SCBA Chairman of the Board and President David A. Neumann and SCBA Board Member Jeff Mercer publicly opposed the zoning request at City Hall.
The building owner had leased this building to a business who desired to open a sexually-oriented business. As a component of the SOB, the business wanted to have 10,000 square feet of retail space to sell and/or rent sexually-explicit material.
Such use of a building for a SOB is allowed under the code so long as it is 1,000 feet away from similar or protected use. Therefore, that battle was unwinnable.
But ... the use of this building for more than 3,500 square feet of retail space required a zoning change and was something the SCBA could fight. Under Jeff Mercer's leadership, the SCBA obtained adjacent business and property owners' signatures in opposition to such zoning changes.
Dave Neumann and Jeff Mercer contacted Councilman Steve Salazar and met with him to review this zoning request. Councilman Salazar gave his commitment to support the request. On May 13, the City Planning Commission heard this zoning request at its afternoon meeting. Jeff Mercer represented SCBA in opposing such a zoning change and successfully stopped the issue.
