Red Cross Tour for North Carolina

recently announced several changes to the penalty calculation system for OSHA
citations and this one certainly caught my attention:

Is Employee Misconduct Ever a Successful Defense to an OSHA Citation?

In over thirty years of representing employers who received
citations for safety violations from OSHA, I frequently was told by the
employer, “but, he/she (the employee) violated our safety rules”; “he/she was
trained to comply with our rules”; “we had no way of knowing the employee would
ignore our safety requirements.” They
were sure that employee violation of safety rules should be a winning argument.
It was and is hard to explain to an employer how really difficult it is to
prove this defense to OSHA or in an Administrative Law hearing before an OSHA
Review Commission Judge. The question
is - can it be done?
