COMPLIANCE STILL MATTERS

Given the current economic climate, many are pulling their hair out, not only to make ends meet, but in frustration of ever growing government regulations that take away from the bottom line. Neither the Federal Government, nor any State, has granted a reprieve from any financial regulations, and, therefore, compliance is a must. One thing that is true in any economic down cycle is that people become increasingly frustrated and start searching for the ever-elusive dollar. Many of these people make the trek to lawyer’s offices to pursue claims that just five months ago they may have deemed questionable, but now are grasping at any straw in the glass in order to find a few dollars. Dispute numerous headlines and news stories that car sales are down; many still view the automotive industry and car dealerships as fertile ground for lawsuits. Therefore, extra attention should be paid to the protection of consumer information.

How Do You Define Disabled?

Effective January 1, 2009, the term “disabled” will significantly change for the employer. On September 25, 2008, the President signed the Americans with Disabilities Act Amendments Act of 2008 ("ADA Amendments Act" or "Act"). The Act makes important changes to the definition of the term "disability" by rejecting the holdings in several Supreme Court decisions and portions of EEOC's ADA regulations. The Act retains the ADA's basic definition of "disability" as an impairment that substantially limits one or more major life activities, a record of such an impairment, or being regarded as having such an impairment. However, it changes the way that these statutory terms should be interpreted in several ways.

The ammended act significantly expands what was previously deemed a disabilty. The following is a very good explanation of some of these changes:
